Access to and use of our Web Site ("the Site") and the sale and purchase of services from the Site are governed by the terms and conditions of use and the terms and conditions of business (together "terms and conditions") set out below.
By using the Site you agree to accept these terms and conditions. If you do not wish to accept these terms and conditions, please do not use this Site.
In these terms and conditions: -
"Property ABC" means, Property ABC trading as Property ABC and any other connected organization that supplies the services ordered by you and any successor to its business;
"We and Us" means Property ABC either alone or together with you, as the context requires;
"Working day" means every day of the year except weekends, and English statutory and public holidays;
"You" means the person ordering goods subject to these terms and conditions.
1.1
To the extent permitted by law we and/or our suppliers make no representations or warranties about the accuracy, completeness, satisfactory quality or suitability for any purpose of:
i. the information contained in the documents and related graphics published in the Site; or
ii. any of the listings of whatever nature details of which appear on the Site.
1.2
All such documents and related graphics are provided, and such products (where ordered) are accepted by you on an "as is" basis. Your statutory customer rights are not affected.
1.3
We reserve the right to change prices listed without notice. Prices are correct at the time of order only and relate to Internet purchases only. All orders for services are subject to availability and we reserve the right to refuse to supply any particular person.
1.4
The information contained in the Site may contain technical inaccuracies or typographical errors. All liability of Property ABC howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
1.6
Property ABC reserves the right at any time to revise the prices and information on this site without notice. All orders for services are offers to purchase and are subject to acceptance by Property ABC.
1.7
Property ABC reserves the right to reject any order, or to cancel any order (whether or not the order has been confirmed by Property ABC and your credit card charged) if the services is unavailable, if Property ABC does not deliver the service, or for any other reason (including, without limitation, for the reason that the product ordered had been listed for sale at an incorrect price due to typographical error or other error in the pricing information received by Property ABC from its suppliers).
1.8
Title to any service ordered will pass to you once Property ABC has received payment in full for that service. Risk in any service ordered will pass upon delivery to you. We are not liable for any innacuracies in your descriptions. In addition we shall have no liability to you for any delay or attack to our service or any other matters to the extent that the delay is due to any event outside our control or due to third party contracted agents.
1.9
Property ABC are not liable for any interruption or failure in service due to third party services or deliberate criminal activities, hacking or vandalism. In the event of information being irrecoverable we will not be liable in any event or circumstance for any consequential damages relating directly or indirectly to these events.
1.10
If a payment is sent by Property ABC to a recipient as a PayPal.com payment and the payment remains unclaimed for 14 days from the date of the PayPal.com payment then the payment will be cancelled. It is then up to the recipient to contact Property ABC for the payment. The right for the recipient to receive the payment will expire one full year after the initial order was made or the initial PayPal.com payment was sent, whichever the soonest.
1.11
Refunds: Our standard listing is classed as 'free of charge'. Our upgraded listing service is provided at a fee. You have every right to cancel either service by informing us or using the website mechanisms. If you are not satisfied with our service, refund is subject to the final approval of the of Property ABC. You will have to contact us in any event. You will be informed of such rejection.
1.12
Force Majeure: While we will try and make every effort to meet with our customers' demands, cancellations or variations may be necessary as a result of an Act of God, War, Strike, Lockout, Labour Dispute, Fire, Flood, Drought or any other cause beyond the control of Property ABC.
2.1 Accuracy of material
We are not liable for any inaccuracies of your listing. All information submitted during the listing process is subject to your confirmation and any typographical errors on your part will not be the responsibility of the service provided by Property ABC.
All advertising copy submitted to Property ABC is legal, decent, honest and truthful and complies with the British Code of Advertising Sales Promotion and Direct Marketing and all other relevant codes under the general supervision of the Advertising Standards Authority, OFCOM or any other applicable body; and
We will not be liable in any event or circumstance for any consequential damages relating directly or indirectly to accuracy of submitted material.
2.2 Your conduct
You are prohibited from posting or transmitting to or from Property ABC any material:
2.2.1 that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience; or
2.2.2 for which you have not obtained all necessary licences and/or approvals; or
2.2.3 which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in the UK or any other country in the world; or
2.2.4 which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).
You may not misuse the Website (including, without limitation, by hacking).
Property ABC shall fully co-operate with any law enforcement authorities or court order requesting or directing the Company to disclose the identity or locate anyone posting any material in breach of these Terms
2.2
If you send ideas, remarks, questions, data, graphics or the like ("Feedback/Suggestions") to the Site, these will become the exclusive property of Property ABC, the Feedback/Suggestions will be deemed to be non-confidential and we will be entitled to use or disclose the Feedback/Suggestions in any manner whatsoever, without liability or notice to you. The Feedback/Suggestions or any other information you send to the Site should not be, or contain, material which is offensive, pornographic, defamatory, blasphemous, unlawful or likely to infringe any applicable law, whether civil, criminal or religious. You agree that all material submitted to us is original to you, and not copied in whole or part from any third party.
This advertisers agreement is made between "US" Property ABC and "YOU" the Advertiser.
3.1 You warrant to the "US" that:
3.1.1 You have the right to enter into agreement with "US" and have the right to promote your property.
3.1.2 The material you provide is accurate and you have the right to use the material.
3.1.3 You agree to Property ABC publishing your listing on our web site and any other web sites of our partners if applicable.
3.1.4 You pay any relevant fees asked.
3.1.5 You fulfil any other obligations and agreements you have entered into in regards to your listing.
3.1.6 You will fulfil any reasonable obligations that are related to your listing.
3.2 We warrant to you that:
3.2.1 We will list a free listings as as soon as technically possible.
3.2.2 We will list an upgraded listings as soon as technically possible.
3.2.3 We will clearly state features given with standard listing and upgraded listing.
3.2.4 We list all relevant information submitted to us in accordance with the type of listing.
3.2.5 Refunds will be given at the discretion of the Management of Property ABC.
We are not responsible for the content of any off-site pages or any other sites linked to the Site nor have we reviewed any such site. If you link to any off-site pages or other sites without our prior written permission, such action will be at your own risk. We cannot be held responsible for the contents of any web site which is electronically linked to the Site and which is not maintained by us.
In the event that you purchase or obtain any goods or services from a third party then your acquisition of such goods or services will be in accordance with the third party's terms and conditions and Property ABC will have no liability to you in respect of the same.
5.1
All Site design, text, graphics, the selection and arrangement thereof, and all software compilations, underlying source code, software (including applets) and all other material on this Site are the copyright of Property ABC and its affiliates, or their content and technology providers. ALL RIGHTS RESERVED.
5.2
Permission is granted to electronically copy and to print in hard copy portions of the Site for the sole purpose of placing an order with us or using the Site as a shopping resource. Any other use of materials on this Site, including reproduction for purposes other than those noted above, modification, distribution, or republication, without our prior written permission, is strictly prohibited.
6.1
All disputes whatsoever in nature are subject to the jurisdiction of the UK law courts.
6.2
Refunds will be given at the discretion of the Management of Property ABC.
THE USER OF Property ABC IS PRESUMED TO HAVE READ ALL THE TERMS AND CONDITIONS HEREIN AND FAQ's AND IS DEEMED TO HAVE AGREED, UNDERSTOOD AND ACCEPTED UNCONDITIONALLY ALL THE TERMS, CONDITIONS, PROCEDURES AND RISKS OF USING THE SERVICES AND CAN NOT AT ANY TIME CLAIM IGNORANCE OF ANY OR ALL OF THEM. ALL RELATIONSHIPS OF ANY USER WHERESOEVER SITUATED ARE SUBJECT TO THE JURISDICTION OF THE UK LAW COURTS.
